With the development of society, people's lives are gradually rich, and vehicles become the necessity for the families. The increasing of drivers and motor vehicles led to the enforcement of existing traffic police to control such a large number of transport needs, which causes the consequent rise in traffic violations and traffic accidents each year. For the department of public security traffic management, the tasks become increasingly heavy. The traditional enforcement method can not meet the needs of the development of modern traffic management. Therefore, the traffic department must apply the modern management method intelligent management. Electronic traffic police administrative enforcement is one of the intelligent management. In modern society, this intelligent management model has been almost universal by countries. Electronic traffic police enforcement's high efficiency and great performance can effectively solve the traffic situation of insufficient police, which can save manpower and achieve full-time day and night enforcement effect. It forms a strong deterrent for various types of traffic violations and reduces traffic violations and the consequent accidents. In China, the electronic traffic police enforcement official used in Shenzhen in 1997, which has only thirteen years history. There are many problems in the application need to be explored and resolved for this premature newborn thing. For example, the get of the traffic violations messages and inform, the specification of the punishment procedure, the balance between means and purpose, etc. These are the focuses and problems this paper seeks to resolve.In China, the research about the electronic traffic police is mostly from the working principle of electron transport, management, social effects and so on, that is, mainly from the engineering, management and other areas to study and discuss the general macro- intelligent transportation systems, such as Wang Minzhu's "Dalian Intelligent Management of Urban Road Traffic," Huang Xiaodong's "Study on Design and Communication Systems of Intelligent Traffic Management System in Lanzhou City ", Liu Zhenyu's "public security and traffic management technology on the new direction of development of applications" and so on. The articles which discuss from the legal aspect are very few. As for the foreign research, the domestic research and articles do not specifically related, all as part of intelligent traffic management system for simple instructions. In one view, the electronic traffic police enforcement of Europe and the United States is different from our country's, which is mostly from the principle and effect to describe as an advanced experience and learn from, and not the aspect of law to comment on. Therefore, little information about foreign studying can be found. This paper uses systems analysis, comparative analysis, empirical analysis to introduce the concept and the characteristics of the electronic traffic police enforcement, describe the problems and difficulties of the electronic traffic police law enforcement, and propose the suggestions for the improvement of electronic traffic police administrative law enforcement in order to make some progresses. Specifically, this article can be divided to the following parts:The first part is an overview of electronic traffic police law enforcement. First, the paper defines the meaning and the characteristics of the electronic traffic police, compared with the traditional human traffic police. Then the article describes the means and methods of the electronic traffic police administrative law enforcement. Finally this part analyses the necessity of the electronic traffic police administrative law enforcement.The second part is to give the legal analysis of the electronic traffic police administrative law enforcement. This part is divided into four sections. Section one is the analysis of behavior nature of the electronic traffic police administrative law enforcement; section two discusses the legal basis of the electronic traffic police administrative law enforcement; section three analyzes the subject of the electronic traffic police administrative law enforcement; section four explains the legal foundation of the electronic traffic police administrative law enforcement. The third part demonstrates the problems and difficulties of the electronic traffic police law enforcement, mainly from the legal basis, the modalities of law enforcement, the procedures of law enforcement and the strength of the evidence.The fourth part is to put forward some suggestions about the improvement of the electronic traffic police administrative law enforcement, mainly related laws and regulations improvement, own facilities of electronic traffic police building, improvement of electronic traffic police law enforcement's functions and methods, specification of law enforcement procedures and oversight mechanisms, and the culture of civil consciousness of the law.
