The Intangible Cultural Heritage is not only specific reflect of the core and gene of culture, but also an important supporter of human civilization. In the background of globalization on economy and culture, the protection of the Intangible Cultural Heritage has become the focus all over the world. Many countries have taken effective measures, built effective protection mechanism and made different methods to ensure the effective protection of the cultural heritage. This paper takes the protection of Yanbian Chaoxian Nationality Autonomous Prefecture as an example, From a law perspective, on which the legal protection has researched. At the same time of using the experience of Japan and Korea on the protection of the Intangible Cultural Heritage for reference, we analyzed the current situation of our country and put forward the author's view. We hope trying to build a scientific and effective legal mechanism, so as to promote sustainable development China's minority intangible cultural heritage, and regulate the inheritance and use of intangible cultural heritage.The Chaoxian nationality is a minority which loves their own traditional culture very much. Many of their excellent customs are praised by people. For the protection of cultural heritage, they are also very active. The Chaoxian nationality's excellent intangible cultural heritage came to China at the beginning of the twentieth Century when the north Korean people settled in China. And it hands down as a part of the Chaoxian nationality culture. The Chaoxian nationality is always a minority with strong identification. They worship their culture. Although now in Chaoxian nationality families there reserved kinds of customs and food well, in recent years, some folk activities and traditional art has gradually disappeared in the people's vision. With the passage of time and the impact of modern art, the national young people from temptation apparently lost interest in traditional culture. And successors have become more and more difficult to find out. The similar traditional culture faces the awkward condition to continue.All autonomous regions and other local governments have introduced various policies to protect the intangible cultural heritage. As for the success and development of traditional culture heritage, governments all take positive actions But our country is modern socialist country under the rule of law, legal protection is the most fundamental and effective way. As "The people's Republic of China on the protection of intangible cultural heritage law" promulgated, how to better protect the minority traditional culture had more favorable support. The Yanbian Chaoxian nationality Autonomous Prefecture has made a series of regulations to protect the traditional culture of ethnic minorities, such as the Yanbian Korean Autonomous Prefecture of traditional culture, tourism regulations and so on. The protection of the intangible cultural heritage have specific provisions. Because our country other minority autonomous areas have been developed for the minority intangible cultural heritage protection laws and regulations, Yanbian is necessary as soon as the special protection of the intangible cultural heritage of the separate regulations.In addition, although in intangible cultural heritage protection work, the government is the leading force, we also should encourage social organizations and individuals on intangible cultural heritage protection work.The legal confirmation of social organizations and individuals in the protection work and establishing the reward system is the way to encourage them to set up a protection fund etc to carry out the minority non-material cultural heritage protection work. It promotes minority intangible cultural heritage legal protection to develop.
