Establishing Relief System Of Adverse Drug Reactions Thinking

Adverse drug reaction (ADR) caused great mental ,physical and economic harm to the patients. The damage of ADR is increasingly developing into a social issue, which has aroused great concern in the world. Governments are trying to establish a perfect relief system , while, at present China is still a blank in this area .Firstly , the paper studies the background and meaning of ADR relief system , it introduces and reviews the status quo of ADR relief system at home and abroad ,providing a theoretical basis for this article ; secondly, the related concepts of ADR is defined and analyzed . Through the case analysis it shows China's processing status of ADR's disputes and points out China's existing problems in damaging the appliance of laws and regulations,organizational identification and risk sharing , leads the necessity of constructing ADR relief system in China ; Introduces the advanced international ADR relief system , through concluding and analyzing , provides references for constructing China's ADR relief system , providing practical basis for the study of the paper ; proposes to establish China's ADR relief system by legislation..In this paper , the research methods of combining normative analysis and empirical analysis are used , based on Special Doctrine of Sacrifice,Public Burden Equality Doctrine,Doctrine of Protecting Human Rights and the Theory of Risk Liability etc. It compares ADR relief system's contents of foreign developed countries , summarizes the common rules of relief systems in the world , the core problems of ADR's harm and relief compensation method ; Using the methods of literature research and investigation , it analyzes compensation status and existing problem objectively . The results show that China is lack of legal basis,identification agencies and compensation methods for resolving the non-performing disputes . Finally , on the basis of standard research and actual situation analysis , with the references to the international typical ADR relief system , it presents our country's perfect concept of ADR relief system .
