This study centers on the government regulations as the research perspective:take the Gujiao mining area in the environmental protection in Taiyuan, the capital of Shanxi province as the example. Try to make a discussion of the government regulations in the environmental protection in mining area. Here has accumulated a lot of discussions and researches on the government regulations in the environmental protection in mining area in academic areas. But many of them took the technology of environmental protection as the subject, or why need the government regulations and what the government has done in the environmental protection in mining area; it is the purpose of the research question of this paper.Since reform and opening up, with the rapid development of our economy, the problem of environmental protection is becoming increasingly prominent. Among them, the mining environmental problems are relatively more serious. Gujiao, as the biggest coking coal habitat in China, is the typical mining area; because the serious environmental pollutions suffer the media exposure repeatedly. This paper first analyses the performance and causes of environment questions externality in the mining area. In terms of market failure, the government plays an important role in which environmental protection should be enforced strictly. In fact, what do not reach the designated role led to government failure. Then this research summarizes the organization of the state and local environmental protection and the process of policies development, and concretely analyzes protection policies and methods of policy implementation since the establishment of the mining area environmental in Gujiao. Finally, the methods are proposed to do better.This study bases its theory view on government regulations theory. Through the analysis of the mining area government environmental regulation in Gujiao, found when government makes up for market shortage in mining area, environmental regulation in actual role and should have the role has the disparity, which leads to regulations malfunction. And the government policy is reasonable or not has a great influence on the local environment. At present, mining area is still facing serious environmental problems, and the government regulation still needs further improvement. This academic study can enrich the research of the mining area environment government regulations, and has the model function to the Shanxi mining area and the national other mining areas.
