Engineering project management pattern of fiduciary duty institution produced in Xiamen, China. At present, fiduciary duty institution is being launched a pilot project which is basically summarized as Shanghai, Shenzhen, Xiamen patterns. In July, 16, 2004, 'Decision on investment institution reform' of State Council confirmed engineering project management pattern of fiduciary duty institution in the way of official documents. In 2003, issue of 'Guideness advice of total engineering project contract and engineering project management enterprise' of Ministry of Construction aroused fuzziness of all circles to fiduciary duty institution, total engineering project contract and engineering project management. Based on present research, authors firstly demonstrate the theory and pattern of engineering project management as theoretical and practical basis of fiduciary duty institution; introduce three kinds of fiduciary duty institution patterns in China; analyze the advantages and disadvantages of three kinds of patterns, law frame design of main contract documents in practice, development problem of duty enterprise, category of fiduciary duty institution and dissimilarities among self-construction, total engineering project contract and engineering project management; research supervisement system and fiduciary duty institution of public engineering finance under the pattern of fiduciary duty institution and give engineering practice under fiduciary duty institution pattern. Then, authors analyze economic characteristic of fiduciary duty institution from the point of view of economics and legal relation among main parts under fiduciary duty institution from the point of view of law in order to clarify different formulation and content on different parts among fiduciary duty institution pattern of point of view of economics and law. At last, authors introduce application case of fiduciary duty institution in road engineering project. The research is instructive for understanding on all kinds of views of fiduciary duty institution pattern and guideness on practice of fiduciary duty institution pattern.
