| GATT experienced eight round multilateral trade talks in more than half century and tariff barrier of international trade has greatly reduced and some traditional non-tariff barrier with definite schedule to get out will not take effect gradually. However anti-dump as a trade protective measure recognized and permitted by WTO is adopted by countries frequently, which becomes the new main barrier of international trade. As international competition becomes more sharp, international anti-dump becomes increasingly acute in recent ten years and our country has become the main target the western countries have an anti-dump to. The second international anti-dump forum was held on October 16, 2003 in Beijing. Specialists attending the meeting thought our country had become a country which suffered the most anti-dump investigation and the most serious victim and predict Chinese companies will face the highest peak of international anti-dump in 2005. Our national foreign trade will suffer a serious effect because main trade countries, especially developed countries will limit our national export by anti-dump. The article tries to have a theoretical analyze by defining anti-dump, theoretical reference and effects on economy, at the same time it has a substantial evidence on Chinese anti-dump situation ,reasons and existing problems. According to these, it puts forward choices for our country to deal with international anti-dump, protect our export trade to develop healthily and the righteous benefits of exporting companies.This paper mainly illustrates the points in six aspects:Firstly, mainly making a distinction between dump and anti-dump. I point out that conducting anti-pump is not a casual behavior of a national government and accusing anti-pump must have three basic conditions at the same time: dump, damage resulted from dump and the cause-effect relations between dump and damage.Secondly, analyzing the theory base of anti-dump. On the base of briefly analyzing trade protection theory and policy development, I pose the protection theory of anti-dump. In the meantime, I make the analysis of the origin and development of anti-dumping, WTO and anti-dumping.Thirdly, illustrating the effect that anti-pump has on economics mainly from its effect on import-country' s economics, its effect on export-country' economics and the economic efficient analyses of anti-dump. At the same time, I emphasize on analyzing the effects that anti-pump has on China's economics from its effects on import-export trade, industries and foreign direct investment.Fourthly, on the base of authentic proof of China's anti-dump situation, I analyze the reasons of China's anti-dump and the problems of foreign trade dump affairs and estimate the future development trend.Fifthly, according to above analyses, I put forward the choice of laws and regulations by which our country use to deal with the international anti-dump, especially creatively posing the suggestion that we should positively get support from importer groups of trade partner countries and people and institutions of academic circles and the media that support trade independence, which provides new ideas and policies of anti-dump for us.Sixthly, it elaborated the course of the typical antidumping case ,US anti-dumping against Chinese color TV. At the same time it had important realistic meaning to analyze the gain and loss of this case and to analyze the profound inspiration to our export enterprises. |
