As the human civilization keeps on its advancement,along with the development of legal systems themselves,civil rights have become the nucleus of constitutions and laws in every country of the world,among which the sports rights have received more universal attention by means of the governmental intervention and adjustment.Besides,sports are getting increasingly important in people's lives.Under such circumstances,studies on the sports rights have came to the fore..As a special subsystem in the sports system,the disabled sports are an organic part of the sports course.To confirm and guarantee the disabled sports rights is a theoretical and practical issue which should be adequately attended by the lawmakers and the researchers on the disabled.Therefore,it is good for building a harmonious society when the disabled sports rights have been studied, systemized and then written into the laws expressly with the pointed clauses as the fundamental principals which can guide the assistance,the treatment and the management of the disabled accordingly.To rectify a great many of infringements on the disabled sports rights,to safeguard the realization of their rights and to promote the compensation for their defects and the rehabilitation are helpful for them to achieve an all- round,concerted and healthy development both in body and mind,and it is also beneficial to cultivate and enhance their sense of exerting their sports rights and their awareness of safeguarding their legitimate rights by legal means.In spite of the fact that China has shown its great concern about the issue of the disabled sports,its development is far from adequate and due attention from the social sectors has been scarcely paid to the intrusion on their sports rights at different degrees.In view of the above-mentioned facts,this thesis employs the ways of questionnaire, literature review,experts' interviews and mathematical statistics,nomological analysis to make its exploration into the legal sources and the connotation of the disabled sports rights by reviewing the provisions of the constitution and some relevant laws and regulations in our country and referring to the related international conventions and declarations,followed by the survey on the implementation of the disabled sports in Lianyungang city.The thesis finds it all reasonable to take any of the elements which include sports interests, qualifications for sports,freedom in choosing sports items and the rights of participating sports activities etc.as an origin to define the disabled sports rights..The disabled have the following sports rights:participation rights,rights of the person,freedom rights,property rights,rights to receive sports education,rights for supervision,rights for requests and the protection of the disabled rights,the priority for the disabled etc.The paper also attaches great importance to the general conditions induced from the survey on the disabled sports in Lianyungang city and enumerates the cases of encroaching the disabled sports rights.And then the thesis continues to investigate the problems resulted from the development and the guarantee of the disabled sports rights in China and it ends with the concrete measures proposed for the further development and the safeguarding of the disabled sports rights.
