The College Rear Service Reform is new to our country. Since 1985 the relevant departments and many education workers gave thought to it till 1999.The formal initiation for the rear service socialization among the colleges is just within 30 years so far. After reform, our country's economy system occurred radical transform from planned economy to market economy. During the period of planned economy, the college rear service was completely undertaken by the school, which is "The Rear Service organized by the colleges or The Association". It accelerated the reform of our high education system and also helped the colleges to develop steadily. Furthermore, it satisfied the request of the personnel's basic life support and the school's science and research activities. By this time the college rear service work has obvious commonweal and welfare. The more quickness our social economy and education develop, the more demerits that welfare-oriented college rear service appear. It can't adapt for the fast development of the high education, neither satisfy the diversified demand of the personnel and etc. In order to avoid ending up and develop steadily, the college rear service finally chose socialization reform. Although the government gave support to the college rear service reform in many aspects, they didn't write these policies and methods on the paper which could act as an enforcement of the law. It was just in a simple form of paper or policy to the public, which cannot arouse the full support of the society and the relevant persons, also cannot essentially promote the rear service's socialization reform. The paper mainly does the research under such background.The paper mainly contains four chapters for the research of the rear service reform. The first chapter is the paper's introduction. It mainly elaborates why I chose this topic, the significance of the research, the paper's innovation and short-coming, the train of thought and method of the research, the expression of the literature and the definition of the core concept of the college rear service reform, such as the rear service, the college rear service, the socialization and college rear service socialization, the law and legal relationship. The second chapter narrates the history trail of our country's college rear service reform. It will be narrated in two aspects, one is the history trail of the college rear service reform, another is the preliminary result of the reform till now.The third chapter discusses the legal issues during the college rear service socialization reform process at present. There are seven aspects:the first point is uncertain rear-service legal status. And the obscure law relationship among the three parts involved in the college rear service reform, the legal attribute error of college rear- service, the logistics socialization reform laws and regulations is not sound, the relevant laws and regulations cannot explain distinctly the logistics socialization reform targets. In this part, the author make a comprehensive analysis on the existing legal problems, especially for the legal status of college rear-service and three aspect legal relationship in the college logistics socialization reform make error qualitative, which make a profound research. The fourth chapter, according the law and regulations to push the legal logistics socialization reform. In this part, the article mainly from the following aspect to explain. Firstly, we must clarify the legal status of the college rear-service, which is the foundation of researching other relevant legal issues. And then determine the legal relationship among college rear-service, support staff, college students. In this premise, define correctly the legal attribute of the college rear-service and perfecting relevant laws and regulations construction. Then reference the foreign college rear-service operation modes, proposed though the legislation in china to unified the college rear-service entity model, which can promote the process of college rear-service socialization reform, and facilitating the country, all levels of government, universities and colleges to its own logistics management and operation. The finally part is to strengthen the construction of legal system from three aspects to avoid the legal risk. |
