Open Government Information Confidential Review Mechanism

At present, China is building up positively the Government Information Disclosure System (GIDS). In GIDS, the mechanism for review on confidentiality of the Government information has become the core and key point. In this case, the review refers to the final inspection by the administrative agencies of the Government on the relevancy of that information with secret of state, business confidentiality or privacy, before the information is disclosed on initiative by the agency or by request of others in accordance with law. In a matter of fact, this review mechanism on confidentiality draws a line between the disclosure and secrecy in GIDS, which is decisive on the scope of disclosure of Government information, and make direct influence on the important role of GIDS in the building of socialist democracy, in the reform of political system, in the realization of commonage of social resources and in the building of harmonious socialist society.In this thesis, the theoretical basis of the review mechanism on the confidentiality in GIDS is deliberated on focus. With the justness and rationality of the review mechanism demonstrated in theory, the peculiar characters of that review mechanism is indicated in detail in the thesis. Based on the practices of disclosure of Government information in nearly two year after the entry into effect of the Regulation of the People's Republic of China on Government Information, the shortcomings of review mechanism on the confidentiality are analyzed, and the experiences of foreign countries on review mechanism are introduced in comparative studies. In the end, certain suggestions are proposed regarding to the qualification of reviewing agencies, the standards, the procedures and responsibilities to be followed, and the relief measures concerned.
