| With the development of the education ran by social forces, some conflicts begin to appear, such as lack of faculty, old facilities, and inefficient administration, etc. Among them, the problems of teachers' contract, particularly, the legal relationship between teachers and colleges ran by social forces, have attracted more and more attention from law circle and education circle. Appointment system of teachers of colleges ran by social forces shows itself in contract, which falls into the category of labor contract, stipulating rights and obligations of employers and employees, and playing an important role in solving disputes. Presently, the labor relations between some colleges and teachers are complicated and the rights of teachers cannot be guaranteed, which were partially due to substandard contracts. This paper studies the contracts between Shaanxi colleges ran by social forces and their teachers from the angle of the nature and the rights and obligations of the contract so as to find the illegal and substandard parts. By studying the China Labor Contract Law, China Labor Law and the Promotion Law on Chinese Education Run by Social Forces and the items of teachers' contracts, this paper indicates some problems in various aspects and offers some measures. The paper makes the research from a quite novel approach in that it chooses typical local cases and offers insightful solutions, which enhance the credibility and significance of this paper. |
