| People's complaint letters and visits, as a political system with a long profound history and social basis in China and for people to participate in politics and express their opinions, play a important role in bridging the interrelationship between China and their people through different historical stages. The dramatic increasing in letters and visits activities breeds from China's rapid economic developing speed, the continuously accelerating modernization progress of China's political system, the wake of people's right consciousness and system consciousness as well as fierce social conflicts. Confronted with many contradictions and exceeding expectations, letters and visits system seems to be insufficient to resolve problems and unsuitable to the requirement of times' development. Letters and visits have being facing the critical decision of where to go, its reform nowadays has absolutely turned into a hot issue concerned by the whole country and people. Thus, the debate on the issue of the retention or abolition of letters and visits is totally controversial. The author believes that "abolition" ignores the reality of China's political and social conditions as well as the inappropriateness of analysis on the cause of why the letters and visits system is not good enough. The existing system of letters and visits in our country indicates that it has unique advantages in protecting private rights, expressing public wills, promoting legislation, innovating new system and so on. Meanwhile, basing on the influence and restrict of "path dependency", it should be wise for the letters and visits system to rebuild the system designing on its own instead of arbitrarily canceling it completely on the "shock therapy" only because its insufficiently functioning .On the other hand, the "deposit" certainly praise the status and meaning of letters and visits on China's reform and development though, the excessive decentralization would incredibly undermine the process of China's legal system, resulting in the tension and confusion between administrative and judicial system, and once the degree of decentralization had not been well controlled, it will become the "monster system", thus affecting the development of social and political harmony and stability. This article holds that the key to the letters and visits system reform is to maximize its functional effect; therefore, the functional reconstruction of current letters and visits system is necessary. Based on the systematical demonstration of theoretical foundation and values of letters and visits system, this thesis attempt to entirely analyze the alienation and loss of current letters and visits system, then deconstruct its negative effects completely and develop new concept and direction of letters and visits system and ultimately to the establishment of comprehensive letters and visits system matching China's social development requirements. The thesis believe strongly the key to solve letters and visits problem is rebuilding its functions, and then reconstructing the whole letters and visits system , and allowing the letters and visits system to shimmer bright again as a result in the process of Chinese's reform and development. The thesis consists of 5 sections, generally basing on logic procedure of raising problem, analyzing problem and solving problem.Part one is the introduction, mainly discussed the chosen topic's background and meaning, the related research and comparison, the thesis" break points and researching approaches.Part two mainly focus on the introduction of several essential questions, including the definition to letters and visits , letters and visits system , letters and visits system's functions and historical review relatively.Part three particularly analyzing the alienation and absence of letters and visits system's functions, and necessity of reconstructing it accordingly.Part four is the major content about what functions should letters and visits system build on and how.Part five is summary of the whole thesis. |
