Civil Execution Hearing System is an important approach to solve the problem existed in the practice of court execution and to ensure the fairness of procedure. However, up to now there's no a united regulation of Civil Execution Hearing Procedure nationwide. In the long term practice, the author finds that the Civil Execution Hearing System is not truly fair and stuck in formalization with no effect in most cases. If the procedure is unfair in juridical practice, it will be difficult for the verdict being persuasive for different parties, even it's fair. This will damage the judicial authorities and lose trust from public. Although, there's a lot of discussion and analysis about Civil Execution Hearing System, there's little systematic and pointed research. Thus it's meaningful to discuss the Civil Execution Hearing Procedure today.This article consists of three sections. The first section gives us the introduction of Civil Execution Hearing System, including its definition, significance and basic principle. Then the emphasis is put on three area, namely, where Civil Execution Hearing Procedure is applicable, how to devise the mechanism where the verdict and execution is separated and the counsel meeting is effective, and how to design the Civil Execution Hearing Regulation. Through above discussion, the author hopes that this article can provide useful reference for later research on this area, facilitate the publication of united, fair, just and practical civil Execution hearing regulation and promote the realization of fair execution procedure at last.
