In October 1998, China signed the United Nations Convention on Citizen Rights and Political Rights. In March 2004, China included in its Constitution that the State respects and protects human rights. As the main theme of social reform and development nowadays, respect and protection of human rights, in criminal procedures, demand more attention and protection given to the human rights of the special group of people, criminal suspects. In the modern criminal procedures of various countries, the criminal suspect has become the subject of criminal procedures. China has also confirmed such status of the criminal suspect in its Criminal Code of Procedure and has made much progress in the human rights protection of criminal suspects. However, in judicial practices, such cases of infringement upon the legal rights of criminal suspects as torture and prolonged detention occur frequently. From the perspective of investigation work in criminal procedures, combined with the experience gained through many years of investigation work of the author, this article analyses the main problems existed in the human rights protection of criminal suspects of China from four aspects, namely theology of human rights protection of criminal suspects, international practices of human rights protection of criminal suspects, current status of human rights protection of criminal suspects in China and suggestions on strengthening human rights protection of criminal suspects in China, especially from the comparison of the practice of human rights protection of criminal suspects between China and abroad, and finally puts forward some suggestions to improve China' s human rights protection of criminal suspects in the process of law-making and law enforcement as well.
