Bada ancient wild tea in Menhai of Xishuangbanna,Bangwei ancient transitional tea of Simao,Nannuoshan ancient cultivated tea in Menhai of Xishuangbanna,Qianjiazhai wild tea community in Zhengyuan of Simao and Jingmai millennium cultivated tea plantation are the typical representative of yunnan's ancient tea and tea plantation, and they are highly praised by the experts and scholars at home and abroad.But behind the joyful respect, what we have done are not the respect and the protection for the ancient tea and plantation, but the surviving crisis that caused by various artificial reasons especially economic reasons.Although there are means of protecting ancient tea and plantation, the legal protection may be a better choice. However, the present laws are unable to protect the ancient tea and plantation in Yunnan completely and effectively no matter from international laws or the laws in our country.So the legislation to the plantation of Yunnan's ancient tea and plantation is carried on into an urgent matter. And playing the role of laws fully is also inseparable from the effective execution and supervision mechanisms. The government's effective legal protection will make the laws and regulations of protection ancient tea and plantation fulfill. The participation of community sectors makes the matter implementation. With these three aspects' consummation, it will from the effective legal protection mechanism for the ancient tea and plantation, and then it will make the true protective to Yunnan's ancient tea and plantation.This article firstly starts from ancient elementary knowledge, such as ancient tea, ancient tea plantation's definition, classification, and value obtains, points out the significance to Contemporary China of ancient tea, the ancient tea plantation. Secondly, it introduces the rich resources of Yunnan's ancient tea and plantation, and from the point of the heavy damage of Yunnan's ancient tea and plantation, it indicates the ancient tea and plantation need urgent protection. Furthermore, it analyses the main laws and regulations of ancient tea and plantation protection and points out the importance of special legislation. Finally, through special legislation as well as the establishment execution and the supervision mechanism, this article will lead to the purpose of establishing and consummating the Yunnan ancient tea, the ancient tea plantation legal protection mechanism. And with this a series of endeavors, we believe that Yunnan's ancient tea, the ancient tea plantation will certainly be able to appear the new vigor.
