This paper taking the perspective of Chinese social movement from1940—1947, aims to analyze the function of constitutional discourse anddemocratic discourse in constructing the social order in 1940 and interactionbetween these two discourses on the base of frequency of emergence of the twodiscourse in the books and periodicals at that time.The introduction gives an idea of the methodologies used in this paper: theresearch of discourse in vicissitude, the use of data-base used in the research ofhistory of modern thinking, the method of epistemic sociology and so on.The first chapter the analysis of the frequency of using the discourses"constitution" and "democracy" respectively in the periodicals from 1940—1947disclose the phenomenon reflected by the change: the time effectiveness, thedeviation, and the different fields of "constitution" and "democracy" to bringforward the problem.The second chapter the analyses of the political background of expresser andcarrier of "constitution" and "democracy" further analyze the different fields of"constitution" and "democracy" and get the conclusion that they were used bydifferent people in different periodicals.The third chapter constitution, what for? suggest that "constitution" is boththe aim of state founding and a "topic for discussion" of political mobilization.Kuomintang maneuvered all kinds of recourses to grasp the leading position ofinstitutionalizing "constitution" and make the "constitution" an instrument forappealing to democracy in order to strengthen the legitimate of themselves.The forth chapter democracy,what for? analyze the political significance of"democracy". "Democracy" is a discourse instrument used by the out-party toconfront with the Kuomintang. It also considered being a way to deliver oneself ofright The judgment "constitution is democratic politics" by Maozedong is underthe influence of Sunzhongshan who interpret the constitution a way of implementthe democracy which can be considered a common sense at that time.The conclusion "constitution" and "democracy": an unharmonious music brings forward the identity behind the deviation of "constitution" and"democracy". "Constitution" and "democracy" can be considered to be twodifferent signifiers with one same signified: to establishing a kind of order withinsome system which can be operated and at the same time a kind of legitimatedvalue guidance provided with some moral rallying point. The illegibility of thejudgment "constitution is democratic politics" reflect the pragmatism position ofChinese politicians, the split between "moral rule" and "political rule", the conflictbetween belief and authority and the contradiction between freedom and ordersuch kind of problems existing in the process of construction of Chinese socialorder.
