It is a difficult problem to determine the surplus behaviors in the theory of criminal law.And intentional injury is an offense which happens highly and hurts peoples health hardly. To crack down on criminal exactly and strongly, on the basis of joint offense theory , the author will research the surplus behaviors in the intentional injurys, wishing it will do benefits to our criminal legislation and the practice of the udicature.This paper includes four aspets: The first part is about the basic theory of the surplus behaviors in the intentional injury, including the conception ,characters and principles of resolution.The second part is about the styles of the excessive perpetrators, including three points:duplicate surplus behaviors and unduplicate surplus behaviors,surplus behaviors in the same constitute and surplus behaviors in the difficult constitute;surplus behaviors to the organizors,accessories and executors.The third part is about the determing standards of the surplus behaviors to the organezors, accessories and executors.The fourth part is about the surplus behaviors in the intentional injury of exployment.The surplus behaviors under the situation that the exployer giving the general intention,that the executors wrongly hurt the other people who are beyond the exployer's meaning,that the executors commit aggregated consequentid offense,and that the executors commit the other offenses which are beyond the exployee's intention.
