On China's Reeducation Through Labor System Is Further Improved

The education-through-labor system with the Chinese characteristic has already passed through 50 years' wind and rain course, being produced at the initial period to eliminate the hidden counter-revolutionary persons after fresh China established. It has became parallel with the penalty system and the public security punishment system until now as one kind of education transformation measure.In a short ,the education-through-labor system has played the vital role in our country.But along with the system of legally ruling a nation gradually establishing, the various countries specially now more and more pay attention to human rights and procedure justice and so on in their legislation . Our country's education-through-labor system, which constructs the existence under weak and insufficient theory ,exists many questions and shortages in the implementing procudure and practical operation.Education-through-labor system also violates "LegislationLaw"and" AdministrativePunishment Law".Education-through-labor system therefore receives the doubt in rationality and validity.And whether it should be exited also causes intense argument.This article elaborates the China education-through-labor system' history formation and its development, and compares it with the overseas correlation system; and analyzes the present education-through-labor system' question in existence.Then I ponder our country education-through-labor system reasonably,and think that it is necessary and feasible to continue the system, but we should carry on reforming along with society's development.The education-through-labor system' reforming and improvement should take the respect for human right, the safeguarding human rights as the objective, and at the same time pay the proper attention to controling anticipatory crime growing and maintaining the government order by law, realizing the judicature to be fair.In this foundation I propose the construction mentality in its legislation for the education-through-labor system reform and the improvement which is in dispute , in order to have a benefit for the education-through-labor system to improve.
