Jurisprudence Of The Social Assistance System Of Thinking

Acting as the foundation part in the social safeguard system, social assistance is called"shock absorber"for the economical development and the last safe net for the solvement of poverty. nowadays, many counties have founded increasingly improved modern social assistance. From the mid of 90s last century, responsing to the change of situation, we reform our traditional social assistance, but there are still many problems which need changing. Thinking about and researching social assistance from the perspective of jurisprudence is essential to the reform and practice for our social assistance.This paper emphasizes on analyzing the social assistance from the perspective of jurisprudence, the following five sections are included:The first section, the generalization of social assistance. This section describes the origin and evolvement of social assistance generally, and defines concept of the social assistance, and analyzes the difference between social assistance and traditional poor relief by state, which make necessary knowledge foundation for the whole paper.The second section, the jurisprudence basis and value orientation of social assistance. This section analyzes the jurisprudence basis from the two aspects of human rights and justice theory, and then discusses the value orientation of social assistance. This section is the core of this paper.The third section, the contrast and inspect of social assistance. This section inspects social assistance of England, America, Switzerland and Taiwan district, and generalizes the general trend and characters of social assistance development.The forth section, the historical vicissitudes of our social assistance. This section generalizes the vicissitudes and development of our social assistance before and after the foundation of PRC.The fifth section, the problem and improvement of our social assistance. This section analyzes the current problems of our social assistance from such aspects as idea, legal system and institution design and provides advices.
