Study Of Legal Issues In China Real Estate Agents

Since the reform and opening up, with the gradual establishment of China's socialist market economic system and the adjustments of the state's industrial policy, the development of the real estate of our country has been unprecedented, and the real estate intermediary industry has gradually developed. The real estate transactions and general merchandise transactions have different characteristics, which decide that the intermediary in the real estate industry has irreplaceable status and plays a very important role. However, because of the imperfect nature of the legal system of real estate intermediary, while the great development in the intermediary in the real estate; there are many problems, which cause serious interference in the real estate market of our country. Therefore, the study and improvement of real estate intermediary legal system has become the primary task which must be solved for the further development of the real estate intermediary industry.This article is divided into four parts:Part I: The first part introduces the concept of real estate intermediary, and describes the theoretical basis on which the real estate intermediary law produced and the legal relationship in the intermediary real estate. In addition, this part analysis of two principal problems in the real estate intermediary law: (1) the real estate intermediaries and their rights and obligations; (2) the real estate intermediary business features.Part II: This part focuses on the analysis of the basic framework of our existing real estate intermediary law, and pointed out the shortcomings which need to improve.
