The right to education, as a basic right of citizen, is the output of bourgeois revolution and the development of human beings. And it has been acknowledged and safeguarded generally. The right to education contains the right to the opportunities of education, the right to conditions of education and the right to get just comments.The realization of the right to education is closely attached to the responsibility of active action. The government should not only confirm the right to education, but also make sure the right and the equality.City-peasant worker is the output of the urbanization. And it's a complex project to do with this project. The right to education of the children of city-peasant is a key issue. First, as a basic human right, it is very important to the individual development.Secondly, the number of the children of city-peasant worker is so big and the government and society pay little attention to it and the current situation is terrible.Thirdly, from the angel of sustainable development and the construction of the harmonious society, the realization of the right to education is also in need.This paper gives the following measures:First, to revise the clauses related, including add the right to migration. It is closely attached to the right to education and it is also the basis of the right to education. And to add the principle of prohibition of prejudice with the principle of general equality. To revised the clause 46 into"Citizens of PRC have the right to education".Secondly, to revise the laws and regulations related., including revising the Register Regulations of Hukou and the Compulsory Education Law .Thirdly, to make a unified Education Law of Mobile Children and to give the children of city-peasant a general protection.
