Forfeiting Financing Of The Major Legal Issues Research

With the entry into WTO, it takes opportunities and challenges to the Qiinese banks, and the foreign banks try to occupy the Qiinese markets by their rich management experiences, high-quality services and various finance products. The international finance service, as the main field being opened in the Qiinese market, will be under the high pressure from the competition. Therefore, how to import and innovate the new international finance products and enlarge the serving field on the basis of the present international finance business has become more important for the Qiinese banks to solve urgently. Fortaiting appeared nearly after the Second World War as a new kind of international settlement product. Gradually, with its low risks and high profits, it has had almost forty-year history as being an very important and widely used finance product in the western world. However, the studies on this subject, especially, in the legal field, are limited and insufficient Hence, it is necessary to study and import forfeiting in order to face the foreign banks' challenges and serve the Qiinese finance and trade better.The main aim of this dissertation is at supplying some useful reference to the legal studies on this subject and attracting more people's attention to the this fieldThe body of this dissertation is divided into four parts. It begins with the outline of Fortaiting, which gives the reader a primary understanding of fortaiting. The following three parts are written to analyze and discuss three legal matters of forfeiting finance service separately, including legal nature of forfeiting finance service, non-recourse terms in fortating agreement and guarantee in forfeiting finance service.
