The rapid development of Internet and information technology develops problem for online copyright as well. As far as it goes, our online copyright law is severelybehind comparing to the requirement of reality. This paper will try to give an analysis of problems hot about online copyright theoretically and practically. It's roughly 40,000 words, consists of 5 chapters.Chapter 1 is a brief about the content of online copyright. It discusses the content of online copyright and separates it into the personal right and the property right. For the challenge that the personal right of copyright is currently facing because of the development of Internet, this part suggests that to transfer the personal right. In the property front, this part mainly discusses the right of duplication and the communication right.Chapter 2 is made up be two sections: the subjects and objects of online copyright. The objects take up the main part. This chapter introduces and discusses the collection work, the e-books, shareware and freeware.Chapter 3 is about the restriction of online copyright. The essence of this system is to achieve the perfect interest balance between the copyright owner and the society. This part discusses about it and suggests in current condition, the balance should be inclined to the society. Then there's a discussion about fair use, legal permission and some other permission system.Chapter 4 discusses about the legal protection of online copyright. It analyses the principle of the tort liability of online copyright, and divide the person liable (ISP) into ICP and IAP, then discusses about the problem of hyperlink infringement. After that, this part gives an elucidation about the standard of infringement satisfy and the district jurisdiction.Chapter 5 is a sum and conclusion about the suggestions spread over the 4 chapters ahead.
