The Legal Protection Of Bank Customers Financial Information Research

In the business of banking, the interests of the clients about information were violated sometimes. There are two ways to resolve this problem. One way is to emphasize the bank's duty of keeping secrets, another way is to put forward the conception of financial privacy right to protect the interests of the client about information. Although the above-mentioned theories seem to be reasonable, they do have some problems. This paper was written to give the third way to protect the interests of the clients about information.With the development of the society, information has been one of the most important wealth. But we haven't pay enough attention to this situation. The fact that we do not treat"information"as one of our wealth and try to save it carefully should result in that the motivation of transaction would be reduced, the resources would be wasted and the economic efficiency would be cut down. On the contrary, if we accept the fact that the information is a kind of wealth, and endow the clients with informational right of finance, it is propitious to protect the interests of the clients. Therefore, the author tried to set up the system of informational right of finance to protect the clients'interests.This paper includes four parts. In the first part, the author analyzed the necessary of protecting the financial information of bank's clients. The reason lies on three facts: firstly, financial information has been one kind of wealth; secondly, the clients were too thin and weak to deal with the banks; thirdly, to deal the business, it is necessary for the banks to protect the interests of the clients about information.
