Patent Funded Legal Issues

With the arrival of the knowledge economics, the type of intelligence capital hasplayed a more and more important role in the high-tech manufacture. In manyhigh-tech enterprises, the form of capitalism with patent has changed into moreessential. So this paper tries to have some research in the angle of law with the subjectof the capitalization of patent in the high-tech corporation.Firstly, according to the situation of nowadays, this paper gives a brief view ofthe concept of patent capitalization. Analyses the legal relationship of patentcapitalization in jurisprudence view, then draw the conclusion of the object of patentcapitalization. And then, this paper gives a brief view of the evolving process of the patentcapitalization in the foreign countries, and then points out the experience to China.In chap 3, this paper introduces the patent evaluation method and gives somelegal advice on it.Lastly, combining the newly promulgated corporation law of China, this paperhas some research about the statutory status of the shareholder who capitalizes withpatent and points out some legislation deficiency in this area and then gives someconstructive suggestions.
