Hayek, The Rule Of Law Thinking On The Legal Construction Of The Revelation

Practising the ruling of law and constructing the socialist country governed by law is our Party' historical choice, which is made on the basis of deeply summarizing the experience of the construction of democratic politics at home and abroad, and in the great practice of developing the socialist market economy , constructing the socialist democratic politics and flourishing socialist culture . From the angle of history and reality, it is a considerably grand systematic project for us to change the traditional Chinese society into a society governed by law with modern characteristic and times' flavor. Retrospecting the course of the ruling by law, we can find there are experience as well as lessons. Only when we summarize the experience and imbibe the lessons, can we avoid following the same old disastrous road and try our best to go away from the wrong road , even not do it. On the other hand, we should, with the open-mindedness, based on the foundations of the China's actual conditions, imbibe critically the theory and practical experience of the other countries, including some thinkers of western countries ,even some with anti-socialist ideology .such as Hayek . As long as they are subservient to us, we can use them according to our purpose, but we should skim the scream and get rid of scum of them, in order to push forward smooth development of our socialist construction of ruling of law. What we must prove is that, as the leader of the new conservatism ideological tread, Hayek stands on the point of capitalist, and defends the capitalism, esp. his standpoint of anti-socialism. As to this, we must have sober understanding, should firmly criticize .This paper expands itself just based on this logical beginning.This paper consists of three chapters. The first chapter introduces mainly about the main principles and factors of Hayek's ideas of ruling of law, as well as its systematic arrangement and procedure's safeguard. The second chapter expatiates on the experience, lessons and the malpractices of the construction of our country governed by law. And the third chapter, which based on the first two chapters above, analyze the useful factors of his ideas which contributed to us, and thus put forth some measures, according to China's actual conditions.
