On Property Rights Promote The Construction Of Constitutional Significance

The property right is very important in the daily life and the property also lay foundation stone to the rising of the market economy. More important, the property right is meaningful to origin of human rights, and it is the pillar of the construction of the constitutional government. The thesis is mainly divided into three parts:First, this thesis studies some theories concerning property right.This part involves the property right's connotation, the traditional western theories about the property right and its effect on the Euro-American politics and economics history, and etc. In the part of this article, we can draw a conclusion, that is, the thoughts of protection of property right in west make a tremendous contributes to the western economy and constitutional government. The protection of the private property rights is indispensable for the humankind to develop, which we can learn from the history of china and abroad.The second part is the backbone and kernel in the article, the author give us a more clear analysis and continue deep excavation into the property right myth.In the several elements of the constitutional government nation formation, the market economy is the most important factor. Then, we analyses the signification of the private property rights by using the institutional economics principles. And the property right is the basis of the market economy. Besides, the property rights also play a very important role in human rights, political system and advanced culture.In the third part, the writer turns the visual field to our country. After describing the traditional attitude towards people's property, the author pays attention to the actuality after the latest constitutional amendments is issued in China. Finally, this author tries to give us some suggestions.
