Constitutional Reform From The Perspective Of Market Economy

Constitutionalism is the common achievement of human's political civilization. Faced with the new situation of building up the socialist well-off and harmonious society and the new aspect of perfecting the socialist market-oriented economic system in China, it's a key subject we need to solve about how to develop our constitutional system nowadays.This article analysis some points from the aspect of the market economy and constitutionalism:We can see the basic theory about constitution in part one. We point out the fundamental value of constitutionalism by comparing the different understandings on the concept of constitutionalism in western and eastern.In part two of the article, it emphasizes the origin of constitutionalism &economy and the property of constitutionalism. It indicates that we must regard the restriction of the state authority and the protection of citizen right as a start of constitutionalism. Furthermore, the cores of them are the financial power and the right of property.Thought the introduction of the market economy in part three, we can find he market economy and constitutionalism are the community that interdependent and indivisible. The key factor to coordinate the relationship between them is, in one field we have to elaborate the constitutional function to promote the market economy, and in the other field the market economy also can offer much better conditions for information. At the last part of this article, we think about the measures how to realize the value and target. In theory, we have after the deeply studying about the constitutionalism; we address the defects which need to be supplemented. We must insist on and follow out the principle of democracy with the rule by law, restriction of the power and the government, security of human rights and property. And it is a new trial and exposure to construct the legal system, economy platform, the constitutional order, and the culture atmosphere.
