China And The United States Export Administration's Legal System Is A Comparative Study

With the development of global economic and the fastest rapid improvement of international commercial trade. More and more technological export has happened in the world. Following it, some new challenge we have to face. As the super power, USA is the biggest country that does the most technological export in the world, Furthermore, USA is also the country that takes the strictest rules to control its technology export. China, as the fastest improvement developing country in its technology export, is in the period whose law institution of technology export is becoming better and better.In the thesis, compared with the law institution of technology export management between China and USA, the author draws the following conclusion: The law institution of technology export (abbreviation: LITE) of USA is more consummate and more perfect, the LITE of China needs more enhance. The LITE of USA shows more random, and the LITE of China shows more stable. The LITE law of USA has its oversea power, while the LITE law of China can' t be execution in the outside world. The LITE of USA takes the discrimination principle to other countries; the LITE of China takes fairly principle to other countries. USA takes multiple administration and single administration to its LITE while China only takes the latter administration to its LITE. However, comparison is not the aim but the way. By using the comparison, it is easier for us to study the LITE between USA and China, and it takes more good use for reference to modify our LITE law, which is including recreate our LITE mode, restrict and strengthen our LITE organization, establish a new administration to control the LITE reexport. On the other hand, with the comparison, we can learn some useful law countermeasures in LITE of USA. For example, wecan make certain the wide LITE of USA, make good preparation to the strict LITE of USA. Finally, as a result, when we need import some technology from USA, we can make it more pertinence and more efficient.
