| There is a traditional point of view that Han Dynasty inherited Qin's system, and Confucianism didn't affect the code of Han Dynasty at all. Laws of the Second Year of Empress Lü, unearthed at Zhangjiashan in1983, was the code executed in early Western Han Dynasty. Compared Laws of the Second Year of Empress Lü with code of Qin Kingdom unearthed at Yunmeng in 1975, this article confirmed the point of view that Han Dynasty had inherited Qin's system., and it came to the conclusion that the code of both Qin Dynasty and Han Dynasty had been influenced by Confucianism. Some laws in the code of Han Dynasty , opposite to Legalism, complied with Confucianism. The guiding principle of legislation in early Western Han Dynasty mingled Confucianism with Legalism. The article analyzed the background of the legislation ideal. Firstly, the article discussed the character of Han government's policy during the early period . Then it expounded the tendency of identity of the various schools of thought during pre-Qin period. Finally, it pointed out that though the legalism was the dominant official theory of Qin Dynasty , Confucianism had affected policy and code of Qin Dynasty, and the extent of influence on Han's code by Confucianism was much deeper than on Qin's code. |
