China adopted the reform and opening policy at the end of 1970s. Thereafter the closed door to the world has been opened. Since then Chinese economy and foreign trade have developed rapidly and achieved great accomplishments. With the development of Chinese economy and foreign trade, there arise in Chinese trade with other countries more and more disputes, one of which is that our products are frequently accused of anti-dumping.Chinese market economy has come into being after more than twenty years' construction. Because of various political and non-political factors the development of Chinese market economy has not been approved by western countries. Therefore they regard China as a non-market economy country in the cases of anti-dumping and apply "surrogate country" as the criterion in adjudicating anti-dumping cases, which brings forth much difficulty to Chinese enterprises' reply to accusations. For this reason it is of positive and practical significance to study the importance of non-market economy in the case of anti-dumping and the countermeasures of our country.This dissertation consists of four chapters. Chapter One is about non-market economy and anti-dumping. It summarizes the connotation of dumping and the law features, anti-dumping and theoretical grounds, points out the present anti-dumping condition China is faced with and the main characters, analyzes the relationship between the non-market economy and the gray barrier in the anti-dumping. Chapter Two exposits the criterions and compositions of the market economy hi the view of anti-dumping, with the focus of the present condition of Chinese market economy development and the embarrassment that Chinese non-market economy faces in anti-dumping. Chapter Three deals with the determination and the selection of the surrogate countries, the determination of the value of the surrogate country and the effects it brings to China. Chapter Four proposes the corresponding countermeasures under the non-market economy environment in the respect of enhancing the market economy, strengthening the government's negotiations with the foreign countries, realizing the effects of the associations and developing the enterprises' motives and potentials to reply to accusations.
