Research On Financial Supervision

This thesis mainly researches the current theory and practice of financial supervision in China.The researchment of these problems is the need of rectifying the order of domestic market economy and especially the financial and fiscal order, of improving the efficiency fo the use of financial fund, of constructing the frame of public financing and also the need of development of socialism market economy. Through analysis and researchment, this thsis tries to clarify the theories about financial supervision, draw lessons from the experiences of developed countries, present problems of financial supervision in our country and the conception of solving these problems. This thesis divides into four parts, and the main means of researchment is normative analysis.First, this thesis talks about the normal researchment of financial supervision theory. For one thing, the thesis analyzes the meaning and essence of financial supervision, viewing the financial supervision as means of financial management. Then this thesis analyzes and summarizes the relationship of principal-agent theory and financial supervision. This thesis thinks that the source of presence of financial supervision under market economy is due to the frustration of public equity agent by government, and the problem of asymmetric information is the cause of the frustration. Agent by government also exists the problem of incentive deficiency and solving the agent problem is only through strengthening supervision. This thesis also researches and develops some theories about the efficiency of financial supervision. It researches the changed track of financial supervision costs and yields that variate as the financial supervision degree changes. Then it arrives at the most benefit point of financial supervision degree.The second part is about international experience of financial supervision and present helpful suggestions. This thesis divides the financial supervision system of main developed countries into four types: financial supervision system type of legislation, financial supervision system type of judgement, financial supervisionsystem type of administration, and financial supervision system type of independency. According to different supervision types, this thesis talks about the experiences of Australia, France, Sweden and Japan. Then the thesis draws lessons from four aspects of supervision responsibility, supervision agency establishment, management of supervision agency, and supervision programme and pattern.The third part discusses the result that our financial supervision work has deserved and the exist problems. Now our financial supervision adjusts to the demand of public finance, legislation construction develops continuely, supervision agency and procession have been strengthened, law conforming consolidates, and supervision pattern have been affluenced. At the same time, financial suprevision has some problems. Our legislation system of financial supervision has some flaws, supervision responsibility confuses, supervision pattern can't operate scientifically, the degree of performing supervision can't satisfy the demand of economy development, and financial supervision cannot cooperate with other supervisions well.The fourth part, the most important of this thesis, brings forward the imagination of completing our financial supervision system. The thesis first discusses how to establish and complete legislation system of financial supervision, then it tells how to clarify supervision responsibility, illustrates how to establish the mechanism of financial supervision management, and discusses the work to enhance the degree of performing financial supervision laws. At last, the thesis presents we shouls rightly harmony the relationship of financial supervision and other supervisions.
