Study Of The Development Of Trust Business Legal Issues

Chinese trust and investment companies reorganized are faced with both the good turning point and powerful competitions of international financial institutions. It's very important to study the development of Chinese trust and investment companies in the perspective of law. In the way of history, empiricism and dialectics the article expounds some legal problems of development of trust and investment companies: (1) history: the evolution of trust and formation of its characters of law; (2) empiricism: the history of development of Chinese trust and investment companies and the control of law; (3) development: the innovations of trust and investment companies and regulation of law; (4) supervision: reestablishment of the supervision system of Chinese trust and investment companis.The first part is of "the origin of trust", "emergence of trust and co-development with civil society" and "formation of the legal characters of trust", which are mainly concerned with the emergence of trust, civil society and so on. The second part is composed of "the development and the legal control of Chinese trust and investment companies before liberation", "the development of Chinese trust and investment companies after liberation " and "the innovations of traditional trust and investment companies" and empirically analyses the experiences and lessons of the development of Chinese trust and investment companies. Development is the chief aim of trust and investment companies and innovation is the important way to develop Chinese trust and investment companies. The third part of the article discusses how to cultivate Chinese civil society and deal with the relation of financial innovations and regulation of law. Chinese trust and investment companies must go the way of innovation.In the same time trust and investment companies can't develop healthfully without effective supervision. The fourth part holds that we should establish the system of trust supervision composed of the specialized supervision of trust supervision organizations, self-discipline supervision of the industry of trust and social supervision. We shouldn't neglect the perfection of the mechanism of self-restrain of trust and investment companies in order to keep trust and investment companies develop healthfully.
