On The Legal System Of China's Overseas Investment

After 20 years' development, China has become one of important capital output countries in developing countries. The entrance of the WTO provides a good opportunity for further development of China overseas investment. Compared with its booming overseas investment achievements, the related legal system research is still backward. How to strengthen legal system research and how to improve legislation and management of China overseas investment is a pressing task before us. Using the successful abroad experience for reference and connecting it with China's facts, the author tries to make an initial research on perfecting legal system China overseas investment.This article consists of three chapters:In chapter one, the author defines the concept of overseas investment, lists its legal characteristics and gives concrete definitions of investment and overseas investment clearly. The author also introduces the related theory of overseas investment and its current development. In the end, the author points out that it is useful for the practice.In chapter two, on the basis of the distinct definitions, the author discusses the defects of China overseas investment legal system and puts forward the legal principal, legal system and cadre content of China overseas investment legislation.Chapter three consists of three parts.In part one, the author describes the facts of China overseas investment and analyses the problems existing in related legal system of encouragement and promotion. Then the author puts forward some legal suggestion on perfecting overseas investment legal system.In part two, firstly, the author introduces the definitions, nature and character of oversea investment insurance legal system. Then the authors analyses the urgency of establishing China overseas investment insurance legal system after joining in the WTO. After comparing two models of overseas investment legal system, the author points out the legal system alternative and contents of China overseas investment insurance system.In part three, the author analyses the problems of the China overseas investmentmanagement system .On this basis, the author proposals the reforming principal, guiding ideology and target orientation of China overseas investment management system. Then, the author presents some detail suggestion on the remodel of China overseas investment management system.
