A Study On The Judicial Mediation System Of Administrative Contract Disputes

According to the administrative procedure law of the People’s Republic of China, newly built in 2014, the administrative contract should be brought into the administrative litigation case, which provides a clear judicial relief way for our country administrative contract dispute resolution. And obviously with attribute of administrative contract, the contract disputes in reality type is complicated. only on administrative review and administrative litigation of the traditional one-way administrative dispute solutions, obviously can’t meet their needs. And if the judicial mediation system which emphases the communication and consultation is applicable to the disputes of administrative contract and how to apply, the legislative provisions are vague and still need for further theoretical arguments and system building. Based on the "judicial mediation system of administrative contract dispute" as the research object, combined with China’s relevant administrative contract relief theoretical results and practical development, the paper starts from the limitations of the existing administrative contract of our country judicial relief system, focus on demonstrating the applicability and feasibility of the judicial mediation in administrative contract dispute resolution.The full text is divided into four chapters except the introduction. The introduction part mainly introduces the research background, research ideas, as well as the current domestic research status and so on. In the first chapter, the current situation and problems of administrative contract dispute resolution are sorted out. The second chapter discusses the current situation and feasibility of the application of judicial mediation in administrative contract dispute settlement. The third chapter introduces the judicial mediation system of administrative contract disputes can be used for reference in the field of internal and external system experience. Study on the combination of the above fourth chapters, this paper will carry on the system construction of judicial mediation.
