| Nowadays, China is in a transition period that various social contradictions and the outbreak of social governance are facing unprecedented challenges and difficulties. In terms of employment, food safety, environmental protection and even the children protection, which in line with the needs of people. With different kinds of social organization emerging, they fill the government oversight in social governance, to a certain extent, which can even ease the social contradictions. It also led to public social organizations and academics reflections on the role and function of social governance. If we really want to play its positive effect, not only by policy guidance, but also from the legal level to establish the status of judicial protection and social organizations ways as they creating a favorable legal environment in China’s development. So we should cultivate more outstanding social organizations to serve the public.The idea of social governance is a product of contemporary social progress, which emphasizes multiple subjects, and the concept of the rule of law echoed. Social organizations participating in social governance is the development of today’s society. The rule of law to achieve the contribution of China has made a work..Currently, however, the relevant laws and regulations of social organization are very inadequate. There are unclear legal status of social organization and lacking of judicial guarantees and legal supervision system. Although, there are some relevant legislation, but a prominent problem to be solved, along with democracy and economic development. There has been a lag, so the social organizations in the legal regulation of social governance are inevitable road.
