A Study On The Standardization Of CPC 's Leadership Legislation

The fourth meeting session of the eighteenth Central Committee of the CPC proposed a goal of institution the socialist legal system with Chinese characteristics. In legislative field, the content of the goal is going to institute a complete legal system. As the leading Party and the ruling party, the CPC plays a significant role in the legislative process. And the CPC plays a key role to form the "good laws". So it is indispensable that we investigate and research the system of the CPC’s leadership in the legislative process. We will analyze the problems of the CPC’s leadership,so that, the CPC play an active role within the legal norm.The first chapter in this paper introduces the background, significance and status of the research. The overall background is the strategic blueprint that the CPC will comprehensively implement the rule of law and comprehensively strengthen Party discipline. Research on the party’s leadership in the legislative process will improve and strengthen the party’s leadership. In the status of the research, I will introduce briefly a few scholars’ representative views.The second chapter is a introduction of the system that the party leads legislation. Firstly, I introduce the provisions of national legislation and regulations of the Party. Secondly, according to the leadership practice of the party, I sum up the party’s legislative leadership that consist of political leadership, organizational leadership, thought leadership and operational leadership.The third chapter is the analysis of the problems existed in the process of legislation leaded by the party. This chapter respectively analysis the normalization and practicality of legislation leaded by the party.When analyze specific leadership of the party, I regard the legislature as a main object.I fully study with the pros and cons of the same level Party organizations and Party organizations within the legislature legislature. The political leadership, the organizational leadership, the thought leadership and the operational leadership pervade every aspect of the party’s leadership of legislature, which the party leads work leadership is mainly manifested in the drafting process of law.The fourth chapter is the introduction of foreign political parties, especially for the ruling party participation in the legislative leadership and legislation. According to the main categories of the current political system, I state the role of party leadership in the dominant party system country, the national two-party system, national multiparty political parties processing legislation, respectively. Drawing lessons from them so that standard our country’s legislation process.The fifth chapter puts forward some proposals for further standardization of the legislative leadership of the party. Combined with the foreign relationship between the ruling party and legislation, I put forward the corresponding recommendations for each specific issue about the party’s legislative leadership, so that the party in power ensure to the exercise of the power according to law, and avoid the phenomenon of the party above the legislature in the process of legislative leadership through legal ways.
