On The Incentive Function Of Economic Law

In the new period to the rapid development of market economy, the incentive function of economic law is very important. But the systematic research of it in the academic circles is still deficient. This paper begins with the connotation of the incentive function of economic law. According to many incentive theories, this paper has built the basic framework of incentive function of economic law’s theory. From teasing those theories, the paper explicate the economic law’s incentive object. And through the discussion of the internal incentive factors and external incentive mode of economic law, it has depicted the mechanism of the incentive function of economic law and has put forward the idea of its institution’s design. We hold the view that, the incentive function of economic law is to ultimately implement men, so this paper is based on human nature and human behavior. The central value of economic law lies in the protection of social public interests, and social public welfare research is the clue that cross all over the research of the incentive function of economic law. Finally, the operation of the incentive function of economic law is aim at optimizing the allocation of resources, maintaining the market order, improving market’s operation efficiency and protecting fairness and justice.
