Research On The Collective Management Fee System Of Music Copyright

The working model of copyright collective management has been run successfully for hundreds of years in the west,but just in practice stage in our country,the establishment of related system still exists many defects.There is no doubt that charge work is the core function of the music copyright collective management organization, but also the key to solve a lot of disputes. The main contents of this paper taker management model of music copyright collective management organization as the baseline, explain some loopholes in charge work existing in practice,thus put forward some recommendations for the improvement of music copyright charge system in our country.The first part of the article mainly elaborates the basic theory of charge of music copyright centralized management institutions.The second part makes a comprehensive analysis on the legitimacy of charge work, starting from identifying copyright charge and copyright fair use, and gets a further understanding of the legal relationship of the three parties involved in the copyright charge work,finally elaborates the justice of copyright charge working of collective management organization from rationality and legitimacy.The third part mainly analyzes drawbacks of charge works that have exposed in work practice in our country. This article explains the problem from three aspects involving the subject and object of charge,the standards of copyright charge and the distribution of copyright fees.The fourth part explain charge system of foreign music copyright collective management and the enlightenment brought from mature mechanism in three aspects including operation mode, fees allocation and dispute settlement mechanism.The last part puts forward some suggestions to improve the music copyright collective management charge system of our country, expecting to be helpful to the development of music copyright protection in China.
