After the reform and opening up, with relaxation of countries to limit their freedom of movement policy, more and more farmers flocked to the city, abandoning agriculture workers, the formation of endemic to China’s migrant workers groups. With the large number of 80,90 migrant workers into cities, migrant workers the intergenerational differentiation, the new generation of migrant workers become the main body of the labor market in China today. They grow in the material is abundant in, life not after many hardships; cultural level is relatively high, premature contact of modern urban civilization, so in the choice of a career, life style and the interests are different from the older generation of migrant workers. New features of these groups decided the new generation of migrant workers in the labor relations at the present time showing different features from the older generation of migrant workers. Our country has always been the tripartite consultation mechanism to regulate the interests of labor relations, due to this mechanism appears earlier in our country, some requirements cannot apply the in the new generation of migrant workers. Therefore, it is necessary to through the research on the new generation of migrant workers labor relations status, so as to alleviate the contradiction between the labor and capital of tripartite consultation mechanism put forward countermeasures and suggestions to perfect.Based on the new generation of migrant workers as the main body, on the basis of Marxist theory of labor relations, combining theoretical analysis and field survey method, has carried on the visiting survey to 270 new generation peasant workers in Henan province, analyzes the current young migrant workers group characteristics and the status quo of the labor relations, and to relieve the contradictions of labor relations tripartite consultation mechanism perfect Suggestions and countermeasures are put forward.In this paper, we study mainly from the following several parts:the first chapter, introduction. The research background and significance, research status quo on the issue at home and abroad, research contents and methods, the innovation of the paper and deficiencies were simply introduced. The second chapter, concept definition and theoretical basis. The third chapter, the current situation of the new generation of migrant workers in Henan province labor relations and interpretation,from the perspective of the new generation of migrant workers in Henan province personal characteristics, summarizes the characteristics of five groups. On the current state of the new generation of migrant workers in Henan province labor relations and reasons to do the related instructions. The fourth chapter, the new generation migrant workers labor relations coordination mechanism and its limitations. On the condition of the new generation of migrant workers labor relations coordination mechanism made in-depth analysis, and the reasons. The fifth chapter, the new generation of migrant workers labor relations coordination mechanism suggestion.Study found:one, the new generation of migrant workers group characteristics are: high degree of culture, thinking more open, skill level is not high, the limited scope of employment, to the citizen identity to strengthen outrageous claims, rights protection consciousness enhancement, development. Second, due to the growth of the new generation of migrant workers and social environment, its own interests demands increase, the concept of enterprise employee, shift, leading to their labor relations also presents different characteristics, interest demands diversification, diversification of labor disputes, labor relations is not stable, awakening consciousness and rights protection mechanism imperfect co-occurrence, enterprise employee ideas change, labor conflicts and cooperation, select laborer dispatching employment, rights and interests of the lack of security. Three, the tripartite consultation mechanism has some limitations, respectively is:the utilization rate is low, become a mere formality, the government’s target, behavior, dual structure deviation, lack of independence of trade unions, rights protection function loss, lack of social responsibility of the enterprise. In order to solve the current labor relations tension, contradiction of labor problems, and achieve the goals of building a socialist harmonious society need to perfect our country current tripartite consultation mechanism. On the one hand, we should build the government play a leading status of labor relations coordination mechanism; On the other hand, the enterprise internal coordination by means of human resource management democratization.Finally, it should actively promote trade unions reform.
