With the steady and rapid development of China’s economy, its energy demand continues to increase, and at the same time, its energy imports also appears relatively substantially rise trend. In 2003, Chinese imported 0.091 billion tons of crude oil, in 2004 imported more than 0.1 billion tons. In 2013, China imported crude oil reached 0.282 billion tons, in 2014 reached 0.31 billion tons. Of all the imported crude oil, 80% crude oil transported by way of shipping, and 80% shipping oil through Malacca Strait. There is no doubt that securing Malacca Strait energy transport channel’s security, to ensure the safety and stability of China’s energy imports, has important practical significance to maintain China’s energy security. The Chinese government put forward the strategy of "One Belt and One Road", promoting international cooperation and jointly promote the international backbone channel construction, Malacca Strait is one of them. However, Malacca Strait energy transport channel security faces various challenges, among which the most outstanding performance is, the Malacca Strait under Three Kingdoms condominium, extraterritorial powers get involved, navigational safety, piracy and terrorism activities. These problems not only brings a serious threat to the Malacca Straits Security, but also brings negative impact on China’s energy imports. To safeguard the Malacca Strait energy transport channel security, we need to strengthen the cooperation between the coastal states and the using country’s coordination. At the same time, in order to promote the cooperation effectively, the harmonization states action, to jointly cope with the Strait of Malacca security threats, improve and perfect the legal system of the cooperation is very necessary. At present, the Malacca Strait energy transport channel security cooperation legal system faces deficiencies, therefore, we need to take improve and perfect measures. As the main channel using country and "One Belt And One Road" strategy promoting country, China should actively promote the Malacca Strait transport channel energy security cooperation, and take effective measures, improve and perfect the legal system to promote cooperation, security cooperation process, and provide guarantee for security and stability of China’s energy importation.This paper make an analysis of the existing legal system about Malacca Strait energy transport channel security cooperation, pointing out the main problems and put forward countermeasures, and make some suggestions and countermeasures on China’s push. Apart from the introduction, the full text is divided into five parts. The first part is the origin of the problem, introduce the legal status and challenges of Malacca Strait. The second part introduces the cooperation progress of Malacca energy transport channel security, explore the international law foundation and restricting factors. The third part discusses the existing legal system, including combating piracy and terrorism cooperation legal system, information and technical cooperation legal system, personnel exchanges and training legal system, financial cooperation legal system, oil spill and marine environment legal system, and points out the main problems existing in legal system of cooperation. The fourth part put forward the countermeasures to perfect the Malacca Strait energy transport channel security cooperation legal system, including clarifying the short-term goals and long-term goals, gradually deepen and perfect,etc. The fifth part is the legal thoughts in the stands of China, analysis the significance of the channel to Chinese energy transport security, introduces the efforts what China has does to promote security cooperation, and make some countermeasures on China’s push.
