Research On Homestead System

Homestead is the land that villagers legally possessed for build individual residential and ancillary facilities. Homestead right is that villagers legally possess, use the homestead, and the construction of housing and ancillary facilities in the homestead and which is exclusively and direct control by themselves.Homestead land system is an important system, plays an important role in ensuring social and economic development and maintaining social stability which has changed over 60 years. And in this process, it has changed by the society but never stop its pace. At this moment, with the gradual establishment of a new economic normality and accelerating process of urbanization, the urban and rural land conflicts have become increasingly prominent. On the one hand, land for urban construction is insufficient supply. On the other hand, homestead land has a lot of idle and waste which should play a role in land supply. In the 2013, the third meeting of the Conference of the mid-eighteenth Communist Party of China National People’s Congress adopted the” CPC Central Committee on deepening reform of the overall number of major issues”, which put homestead land reform as an important part of the system. At the same time, many experts focus on homestead system of property rights, transfer, inheritance rights, "small property room", "counter-urbanization" and many other issues.This article based on the study on the basis of the existing homestead system, stroke clear homestead system development process, focus on the hot issues in the presence of the homestead system, a clear direction of reform homestead system of the future homestead system a preliminary idea.According the research, the homestead system mainly through private ownership, separation of ownership and improve the use of the right to use the right to control four stages since the founding of New China. Its feature embodied in the duality, identity-based distribution, use welfare nature, limited circulation, many links and other aspects of management, planning and program deficiencies, approval supervision, lack of transfer mechanism, power is not complete and other issues.In order to solve all these problems, my study and put forward the way to strengthen toplevel design, reform of property rights, improve the use of control, strictly investigate illegal land use and other measures to make certain exploration. We must deepen the reform and innovation homestead system, optimizing the core of property rights system, establish and improve the transfer mechanism is critical to improve use control and strictly investigate illegal land is to protect, to better protect farmers homestead usufructuary.
