A Study On The Legalization Of Public Interests Conflict Governance

Corruption is cancer for adm inistration. If curbing the extending of corruption, we should not only keep seri ous punishment but also take effective measures to prevent the corruption f rom happening. the experience of anti-co rruption in m any countries and areas shows that ef fective governance system of civil servant interest conflict plays a basic role to prevent corr uption, especially The third plenary session of the eighteenth communist pa rty of China points that we should deepen reform in important and key areas, better the system of anti-corruption, prevent and control the risk of corruption and interest conflict and take more ef fective and scientific ways to prevent corruption.As far as I am concerned, if we can not take effective ways to cu rb interest conflict, it is possib le to lead to corrupt ion. Therefore, institu tionalizing interest conflict of civil servan t is not only the de mand of i mplementing United Nations Convention against Corruption to S tate Parties, but also is the essential part to effectively deal with corruption from beginning. Author analyzing the term of interest conflict, the relation with corruption, the corresponding managing system of advanced countries and regions, the form er managing system of our c ountry by literature research,comparative analysis and em pirical approach. It hopes that we can present effective solving system suitable to our national condition. W e should creatively propose a way –turning prevention to m anaging—to civil servan t, in addition, we should institutionalize interest conflict as a systematic comprehensive project, we must do top-level design and omni-direc tional comprehensive coordinating from macro external environment to micro internal system. Only in this way, can we really effectively institutionalize interest conflict.
