The world military revolution of the 1950’s put forward higher request to the military and national defense forces of foreign nations. In the face of the changing world situation and informational changes in war, every government of the world is thinking and seeking the roads which are suitable to their own countries. As being in an important period of economic transformation and social development, we must bestir ourselves to the situation positively, combined with the current military and social and economic development stage, and finally to make a excellent army of Chinese -style socialism.Any armies’ development can’t exist without their social situation.Looking to our history and the military development in the world, we can see that the martial behavior is closely connected with the political,economic and social development. If we want to research the ways to make our army stronger, we must grounded on the history and reality, and to seek the correct methods with dialectic views. In recent years, it is a big problem for military construction to recruit the best people and hold them on. Active duty soldiers is not skilled in their position, the soldiers’ qualifications and technology is not very good, and moreover, some military men are lack of the sense of ownership and identity,all of these will weaken the fighting capacity of our country. When the Military retired from service to the society,they only have ingle living skill which make them can’t readjust the new life and only depend on the help of our country. It will do harm to our economic development. The root of all these problems is our law. There is no doubt that the law,as a national tool to safeguard citizens’ power and guide the national social and economic life of the superstructure, plays an important role in pushing the development of our forces modernization. Therefore, how to get and keep high quality manpower, maximize forces fighting in my life, and become China’s military, legal experts need to study and face time.This article based on the research on the active duty service system, adopt the empirical analysis, comparative analysis, qualitative analysis method, and from the theory of law of military service system to take a perfect study. By studying active duty service system structure, recruitment conditions and retired policies, this article also have a detailed study to the process of our active service. This paper tends to find the common characteristics among different countries, and furthermore to find the problems existed in the process of our military construction. From the perspective of jurisprudence, it tries to find the ways to solve the problems being in modern military to improve the level of our military construction and finally to achieve professional soldier development road with Chinese characteristics.
