Legal Perspective Of Public Reason

The concept of the public reason become a hot topic. In recent discussion, Different scholars have different definitions about the public reason. It is such for a shared political reason. Most people believe that the definition of the public reason is that, in a modern democratic society, all citizens were thinking, discussion and to persuade each other for the public interest, moreover they use it to solve the problems. On the one hand, The academic background and theoretical resources of this concept comes from the West. Western concepts must based on the Western-centric. This is what we need to understand and pay attention; On the other hand, we are pleased to see that studying on the public reason is more and more and in-depth. They analyzed the concept of the public reason, and put it into China's reform and opening up and socialist modernization practice. In this age, we need a method to resolve the democracy and other social problems. Thus, in the legal community, the public reason has great significance.In the field of law, we must ask ourselves now what foothold we stand and what the research and applicationˊs conditions we have. what we can inspire and what contribution we can do. Therefore ,we must strengthen the theory of the public reason. To Make it better serves the national,the community and the people. To make it applies to modern legal system with Chinese characteristics. To achieve these goals, this paper is divided into three sections: The first part is the basic concept; The second part is the use of Jurisprudence; The third part is combined with the legal reality. I hope that this theory can be well applied in the China's legal practice.
