Law comes to the world as a "regulator" of social relations, which provides norms of conduct for members of society. The good law is the premise and basis of implementing the strategy of ruling by law, and building the socialist country ruled by law with Chinese characteristics. Based on the practical significance and of great value, legislative supervision system becomes the focus of academic attention, which helps to regulate legislative activities, improve the quality of legislation, maintain uniformity of law, enhance the concept of ruling by law and guarantee ruling by good law. This thesis divided into 3 parts, discusses the legislative supervision system analyzes and compares the using methods of value analysis and comparative study.The first part introduces the historical development and status of legislative supervision of our country. It demonstrates the legal basis for legislative supervision: the deficiency of representative legislation, the executive and the reasonable doubt about administrative legislation, law is characterized by the uniform of stability and change. On this basis, the thesis reviews the historical development of legislative supervision system. By clue of the evolution of constitution and relevant laws and regulations, the historical development of legislative supervision system is wholly divided into three stages. This part also illustrates the existing problems and deficiencies of the legislative supervision system.The second part introduces and compares the main modes of foreign legislative supervision system. This section describes in detail three legislative supervision modes prevailing in the world: supervision mode of representative institutions, the judiciary's supervision mode and supervision mode of the specialized institutions. Three legislative supervision modes have their own advantages and disadvantages. Fully considering the advantages and disadvantages of three supervision modes a country should build legislative supervision mode consistent with its national conditions, based on its own actual conditions, which can play an important part in legislative supervision.The third part presents the way to improve legislative supervision system. In terms of the existing problems and deficiencies of the legislative supervision system, this part presents the way to improve legislative supervision system. Improving legislative supervision system of our country has to not only adhere to the principle of constitutional supremacy within the framework of the constitutional system in China, but also adapt to the level of the ruling by law. We also have to adhere to the principles of the scientific and democratic supervision and try to make our legislative supervision scientific and democratic. Proceeding from China's national conditions, power distribution should be optimized in order to enhance the relative independence of supervision. The scope of legislative supervision should be expanded, legislative supervision standards have to be clear and the process of legislative supervision has to be legalized. |
