| With the rapid development of the real estate market, property management disputes become more frequent,the Owner's committee palys an important part in it,the internal and the external legal relation inclued.The article focuses on the duty of the Owner's committee,so that the above two legal relation will be more perfect.The duty of the Owner's committee can be divided the internal and the external. The Owner's committee will meet all kinds of problems, when it exercises the above two duties, so the article sets about problems, researches the theories, and then solves problems. When the article discusses the problems, the critical will alternate the law of Hong Kong and the abroad, and then make the system of the Owner's committee perfect.The purpose of this paper is to explain the Owner's committee questions, and then to seek measures to improved it. This article use the way of theoretical exposition, in order to analysis problems objective and comprehensive. In this paper, the conclusions is: the commission, as agent for the oweners,prodeces contradictory with the owners. Owner's committee and the property services company have equal relation between them. Property services company need change management into servicemen; Owner's committee and the Government have always wanted to stress that property is a private right. The Government should respect the owners of self-government. There are coincidence of responsibilities between the Owner's committee and the neighborhood committee. But the difference is obvious. They should respect each other. |
