Aa Bio-pharmaceutical Company's Patent Management Strategy Study

Along with knowledge economy's arrival, the intellectual property has became the most important element of production and sources of social wealth in the present era, which has also became the principal means on many enterprises'development and competition. In 2008 the State Council issued officially "Country Intellectual Property Strategy Summary", which requests to strengthen our country's intellectual property system construction, vigorously enhance the creation, utilization, management and protection ability on intellectual property right. During period of 2008 ~2009, China has also carried on the third amendment of Patent Law, that has been passed and inforced latter, wherein it has specially added and revised some articles relating to our country's biological medicine, that strengthened our country biological medicine patent practical application and protection.In the system of Country Intellectual Property Strategy, as the important field which superlatively depends on the intellectual property protection and relates the state economy and the people's life, the biological medicine must also establish its own developmental strategy. The biological medicine enterprise must be the principal part of biological medicine intellectual property rights creation, utilization and management. They must hold the chance of current rapid development of the intellectual property and participate in the continuous construction and optimization of our country's biology medicine relateing intellectual property and the system thereof.In view of the fact that to the medicine enterprise, the patent is the most important intellectual property rights form, starting with the patent, developing situation of intellectual property, especially patent, of the global and Chinese biological medicine industry had been summarized and contrasted firstly in this paper. And the main similarities and differents of the domestic and foreign biological medicine industrial development were concluded. The challenge and the opportunity of Chinese entire biological medicine industry facing were proposed; meanwhile digital statistics and the present situation investigation on Chinese biological medicine patent's system and application were made. Secondly, from generally to concretely, taking one of leading enterprise of our country's biological medicine industry----- AA biological medicine company as investigation object, using the method of questionnaire survey and the digital statistics, all-sided in-depth researches on company profile, intellectual property rights management condition, patent management, patent application and so on were done step by step to find the company's shortcoming on various aspects of patent. Subsequently AA's issues on patent creation, utilization, management and culture atmosphere were summarized.Finally, based on the above present situation investigation and the issues, AA's patent management's strategy was proposed, and a series of counter-measure and corrective measure on patent development, system consummation, patent utilization, patent protection system establishment, patent talented person training and the organization building, patent cultural reconstruction was put forward combining with the problems mentioned above. This research expects that from the embodiment of AA company, enlightenment and constructive suggestions on patent development and management etc. aspects of Chinese entire biological medicine industrial can be given.The innovation of this study lies in: Combination of empirical study and data analysis, unification of macroscopic investigation and microscopic discovery, connection between theory and practice. As a result, the paper has a higher utility value.
