Construction Of The Effective Operation Of The Environmental Liability Insurance System

With 30 years' high-speed growth and development, China has surprised the whole world with fascinating progress in its economy. However, while praising the achievement, we have to pay attention to heavy environmental pollution problems that come with it. Faced with such serious environmental situation, it's necessary to build up a new pollution reduction and responsibility system.Environmental liability insurance is one of the most effective mechanisms of managing environmental risk. In the paper, the author strives to improve the efficiency of this mechanism. First of all, the author analyzes the role of environmental liability insurance in dealing with environmental problems and compares it with government supporting programs and tort liability system, pointing out environmental liability insurance should be the core of environment risk managing system. Secondly, the author studies on two essential conditions of the environment liability insurance: insurability and marketability, based on which a series of suggestions are put forward. Thirdly, the author draws lessons from the American environmental liability insurance market. Finally, the author sets up a set of environmental liability insurance system suitable for china's situation, with the function of reducing pollution, punishing the polluters and compensating the victims.
