Research On The Legal Protection System Of Renewable Energy Resources In China

With the aggravation of the energy crisis and the environmental pollution, more and more countries begin to strengthen the development of renewable energy resources. Being a developing country, our country is faced with pressure of economic growth and environmental protection. Developing renewable energy resources vigorously is a logical choice of our country's future energy for sustainable development. Substantial law can promote the development of renewable energy resources. And a good idea of the research is necessary for legislation and law enforcement. This is a basic point for the writing. The writing makes an intensive study of legal protection of our renewable energy resources. The purpose of this study is to perfect the law system of renewable energy resources by exploring overseas legislation and by reflecting on the present situation and the defects of domestic legislation.The paper is divided into three parts, approximately 35,000 characters.The first part elaborates a general survey of renewable energy resources. First of all, the text introduces the definitions of renewable energy resources, and then introduces the characteristics of renewable energy resources. Secondly, this article analyzes the necessity of developing renewable energy resources and points out the barriers which developing renewable energy resources faced in our country. Finally, the article discusses that legislation is an effective means to advance the development of renewable energy resources. Therefore, we must strengthen the fundamental research to perfect our law system of safeguards on renewable energy resources.The second part analyzes the legislative survey of renewable energy resources in our country. First, this text combs present legislation related to renewable energy resources in our country. Next, this article carries on the key narration to "Renewable Energy Resources Law" from the legislative objective, the principle and its establishment's main legal regime aspects. "Renewable Energy Resources Law" has constructed a relatively complete frame for our country's development of renewable energy resources and has entrusted law safeguard and confirmation about the status with renewable energy resources, which is the historical progress. But it also has the insufficiency. Its main insufficiency is lacking the feasibility and strength is insufficient and the related legal regime waits for consummation and the refinement.The third part consummates the conception of legal system on renewable energy resources in our country. This part is the most important part. The author studies the massive foreign legal regime on renewable energy resources, considers our country's concrete national condition and puts forward four proposals. First, in view of the insufficiency of the total quantity goal system on renewable energy resources in our country, the author suggests to set up the quota system of renewable energy resources. It is the consummation and refinement to the total quantity goal system of renewable energy resources. Second, in view of lacking the special fund and bad financing mechanism of renewable energy resources in our country, the author suggests to set up the fund system of renewable energy resources in our country. Third, in view of too little investment to the renewable energy resources, the author suggests to consummate the subsidy system of renewable energy resources in our country. Fourth, in view of the insufficiency which exists in tax revenue aspect of renewable energy resources, the author suggests to consummate tax revenue system of our country's renewable energy resources.
