In our country, the realty business becomes an important component element of market economy, and become the locomotive which pulls to move an economic growth. In the progress of the booming development of the real estate market, the mortgage of commercial residential building emerges because of demand, opportunity etc. It brought a new lease of life for the realty business in our country, and help the capital to circulate, make the financial industry get a development, It alleviated residents to buy the funds pressure of building, and achieved many people's dream of housing. but, in the eyes of the bank, residential & commercial mortgages exist the risk problem which can't be neglected, and the bank can availably bring down the risk or not, not only relating to the stability of himself, but also relating to residential & commercial mortgages can get a positive development. Therefore, the controlling risks of bank in the residential & commercial mortgages become an important research topic. How to build up and improve our country related law system, how to innovate descendible tools about finance and scatter the risk of bank not only have important theoretical value, more have deep realistic meaning.The first part in this thesis is about the current situation about the residential & commercial mortgages, and introduce currently operation process, therefore formed of law relation with among them conceal of huge risk. The next content is analytical to he existent risk in mortgages and pointed out the reason of the bank risk formation in mortgage. The second part introduced an subs prime lending crisis in America first and contrast current situation in our country, analyzing to exist larger risk in the our country of residential & commercial mortgages, then point out the risk about the control of residential & commercial mortgages as our stand. The third part introduces the general ways of doing and experience about the risk of residential & commercial mortgages controlling in the bank, and gives our country valuable experiences about the development of personal housing mortgage loan. The fourth part in this thesis gives the proposal of perfecting the risk of residential & commercial mortgages controlling in our bank by the operation and exterior environment from the bank inner part, combining the existing of the problem of the risk about residential & commercial mortgages and foreign risk control's experience. The finally discuss the mortgage to save or to discard and points out that the discard of mortgage is to be unsuited. Because of can't rescind, the research of the risk of mortgage controlling in the bank just becomes necessity. This is exactly textual to study meaning place.
